Apple Sued Two Stores In New York City For Selling Counterfeit Apple Products

According to Reuters [2], a pair of stores in New York City was sued by Apple for selling counterfeit Apple items. Apple filed the trademark infringement lawsuit last month but it has been suspended until now to facilitate confiscation of the counterfeit products from this stores in Flushing, Queens.

According to a court filing, Apple’s representatives visited these stores multiple times during several weeks where they bought different iPhone, iPad and iPod cases along with stereo headsets for iPhones.

All of those items were marked with an Apple trademark and carried the words "Designed by Apple in California. Assembled in China," and also had markings that is found on real Apple products. According to lawsuit, the packaging of the headset was almost an exact copy of genuine one.

The court granted Apple the warrant to confiscate the duplicate items on July 27th and barred the stores from selling counterfeits. Also Apple has requested that the name of the store, Apple Story, was changed in order to avoid confusion with Apple’s own stores, but the court has not yet delivered a judgment on this issue.

Apple’s lawsuit extends beyond the stores, it also includes all people and organisations involved in the sale, distribution and production of the counterfeit products, however they have yet to be identified.
