Apple removes AppleCare From Sale In Italy



In July we reported that Apple was threatened with a temporary closure of its operation in Italy if the company did not change its warranty policies. Previously Italian antitrust regulator fined Apple $1.2 million for misleading practices of selling one-year AppleCare warranties and not informing customers about a two-year warranty that is mandatory by European Union law. Now it seems that Apple has officially removed its AppleCare Protection Plans from sale in Italian retail stores with only online version of its plans still available for consumers in Italy.

The yacht that Steve Jobs built with French designer Philippe Starck revealed



Super yacht "Venus", the design of which was commissioned by Apple’s co-founder, Steve Jobs, was officially launched in Aalsmeer, on Sunday. The opening was attended by the Jobs` family. 80-metre hull made entirely of aluminum. In addition to "the Spartan” Interior, steering cabin is equipped with seven 27-inch iMacs using navigation, management systems and other software for the operation of Venus.

Five New Apple Retail Stores Opening for iPhone 5 Launch Week

Apple has announced the grand opening of five new retail stores in support of the iPhone 5 launch this Friday. The first opening set for Thursday and the first new store at the Rio Shopping mall will open its doors in the Spanish city Valladolid. The Thursday opening is unusual due to the fact that a brand-new Rio Shopping center also opens this day.

The iPhone 5 launch will be at 8:00 a.m. local time on Friday in nine countries, and at the same time three new stores will open their doors for the customers. New stores include:

Apple Threatened With Suspension Of Italian Sales Over Warranty Concerns

Back in December of 2011 we reported that Italian antitrust regulator forced Apple to pay a $1,2 million fine for misleading practices related to warranty terms disclosure. The regulator claimed that Apple mislead customers by selling standard one-year AppleCare warranty without properly informing consumers of a two-year warranty that is required by European Union law. According to Reuters, now Apple is facing additional fines and temporary closure of its commercial operations in Italy, if the company does not change its warranty policies:

Apple Purchasing Italian Audio Editing Software Company Redmatica

TechCrunch points to a post from Italian Fanpage saying that Apple intends to purchase a small Italian software company Redmatica that develops audio editing apps such as AutoSampler and Keymap Pro.

Samsung denied iPhone ban in Italy

Italian news agency ANSA published on Thursday a report where it revealed that an the Milan-based Italian first-instance court for patent cases has denied Samsung's request for a preliminary injunction against the iPhone 4S, making it the third time the South Korean electronics maker has failed to obtain a ban on Apple's newest handset in Europe.

The Italian court's rejection marks the third straight loss for Samsung in its effort to curb Apple handset sales in Europe, and follows similar decisions by France's Tribunal de Grande Instance de Paris in December 2011 and Dutch court Rechtbank's-Gravenhage's ruling in October.

Both companies are embroiled in a worldwide patent war, though thus far only Apple has seen success in its injunction requests and won bans against Samsung's Galaxy Tab 10.1 in Germany, Australia and the Netherlands.

However, Apple is only slightly ahead of Samsung. The Cupertino Company will have to pay Samsung a significant amount in damages if courts in those states find that the preliminary injunctions were improperly granted. As you may remember, the patent war erupted when Apple filed a suit against Samsung in April 2011, alleging that the South Korean company blatantly copied the look and feel of the iPhone and iPad. The war now spans over 10 countries across four continents.

Italy fines Apple $1.2M for 'unfair commercial practices'

Reuters reports that Apple has been fined 900,000 euros, or $1.2 million, in Italy in response to complaints of "unfair commercial practices" related to product warranty disclosures. Apple sold its products with a standard one-year warranty. The customers had an option to buy a second year through AppleCare, but local laws require companies to protect buyers with a free two-year warranty.

According to the report, Italy's antitrust regulators ruled that Apple has not been providing adequate disclosures about the two free years of product warranty assistance required under Italian law that is why Apple was fined 400,000 euros for not providing adequate information to customers about the length of product guarantees, and another 500,000 euros stemmed from Apple not giving customers enough information about its AppleCare extended warranty.

The authority said Apple Sales International, Apple Italia and Apple Retail Italia did not properly inform customers that they were entitled to two years of free assistance under Italian law. Three Apple spokesmen contacted by Reuters weren't immediately available for comment.

Information provided about an extra guarantee scheme, the "AppleCare Protection Plan," encouraged customers to buy the service without clearly explaining that it overlapped with the free assistance required by law, the competition authority said.

Samsung Decided Not To Seek iPhone 4S Ban In South Korea

According to The Chosunilbo report (via The Next Web), Samsung has at the last minute decided not to seek an injunction against iPhone 4S sales in South Korea, its home country. It appears that Samsung’s decision was driven by public relations considerations and the company preferred not to irk customers in South Korea by attempting to ban iPhone sales there. The company debated until the last minute whether to file the action similar to applications in Italy, Australia, France and Japan. A senior Samsung executive said:

“We concluded that we should engage in legal battles with Apple only in the global market, but not in order to gain more market share in Korea”.

Yesterday Apple launched the iPhone 4S in 22 additional countries, starting the second wave of launches for the new iPhone model. Last week the company began to take pre-orders ahead of the release planned for Austria, Ireland, Spain, Slovenia, Slovakia, Singapore, Norway, Lithuania, Liechtenstein, Denmark, Belgium, Mexico, Luxembourg, Latvia, Italy, Sweden, Netherlands, Czech Republic, Switzerland, Hungary, Estonia and Finland.

Samsung Will Seek To Ban iPhone 4S Sales In France And Italy

Implementing its plans to ban sales of Apple’s new iPhone over infringement of intellectual property, Samsung today has said that it is going to file requests with the courts in Italy and France for preliminary injunction of new smartphones.

“Samsung Electronics will file separate preliminary injunction motions in Paris, France and Milano, Italy on October 5 local time requesting the courts block the sale of Apple’s iPhone 4S in the respective markets”.

Samsung’s requests in Italy and France will refer to patent infringements connected with wireless telecommunications technology for 3G mobile devices. Also Samsung said that it plans to file the same requests in other countries after it reviews the situations.

Today’s statement from Samsung does not refer to the specific patents which iPhone 4S infringes, but it is possible that they are the same patents that already used by Samsung in a Dutch suit seeking the sales ban of iPhone 3GS, iPhone 4, iPad and iPad 2.

Apple has claimed that patents cited by Samsung are essential for 3G wireless technologies and should be licensed under FRAND terms. Apple argued that Samsung has not offered it licensing under reasonable terms, and two companies has been unable to arrive at agreement on licensing of those patents.

Apple Continues Opening New Stores This Weekend

Keeping to the Apple’s schedule, the company opens six more stores on this weekend. It starts with the Nanjing East store in China opening tomorrow (Friday, September 23) and then the IFC (Hong Kong), Hornsby (Australia), Centro Sicilia (Italy), New Haven (Connecticut) and Metrotownn (Canada) Apple Stores will open on Saturday. The Nanjing East store (shown above) is the third Apple in Shanghai. IFC store is the first store that locates in Hong Kong. ifoApple Store notes that this store features a unique design:

The rear wall of both levels are glass windows looking out towards the city. On the inside, the lower level has two wide stainless steel walls, with a visitor entrance in the middle. The walls include back-lit display cases promoting Apple’s products. The upper level has an all-glass front window visible from the mall hallway.
