In China Apple May Face $38 Million Fine Over 'iPad' Trademark Infringement

iSmashPhone reports that in China Apple may face a $38 million fine from government bodies over alleged infringement of the trademark related to the "iPad" name. However, the fine pales by comparison to the $1.6 billion claim from Proview Technology. The company asserts that it owns the rights for the name and seeks to win a series of suits filed against Apple. Also Proview reportedly expects an apology from Apple and seeks an injunction restraining Apple from using this name in China.

Proview first claimed that Apple infringed the trademark in 2010, saying that it had owned this trademark in China from 2000 and seeking compensation from Apple of $800 million. Apple responded with the counter lawsuit stating that it owned the rights for "iPad" name in China after having acquired European trademark from the Proview's parent company for $55,000.

But Apple lost its lawsuit after the court ruled that the purchase did not include Chinese rights as the parent company did not have the power to sell them.

Apple is appealing the December court ruling in favour of Proview Technology, and any potential fines or decision on Proview’s case against Apple appears to be depending on the resolution to this case.
