Customs bust a guy with 170 iPhones taped to his body trying to smuggle them into China

Watch this guy get busted while trying to smuggle nearly 170 iPhones (from our count) from Hong Kong to Mainland China by taping them around his body. This is insane because he's trying to smuggle those phones into where they are made to turn a profit.

NYTimes: Why Apple builds its products in China

employees-work-on-the-ass

The NY published an absolutely fascinating article, explaining why Apple builds almost all of its stuff in China. The short of it is that companies like Apple simply cannot manufacture products in the United States.  The cost is not the reason, however.  Years ago, the Chinese government subsidized building cities of factories that can hire 3,000 workers to live in a dorm in a day —or 8,700 Industrial Engineers in two weeks (it would take 9 months in the U.S.).

The most interesting tale might have been the last minute decision to make the iPhones display glass:

In 2007, a little over a month before the iPhone was scheduled to appear in stores, Mr. Jobs beckoned a handful of lieutenants into an office. For weeks, he had been carrying a prototype of the device in his pocket.

Mr. Jobs angrily held up his iPhone, angling it so everyone could see the dozens of tiny scratches marring its plastic screen, according to someone who attended the meeting. He then pulled his keys from his jeans.

German court tosses Samsung's 3G-related lawsuit against Apple

antenna

On Friday German Judge Andreas Voss rejected Samsung's numerous lawsuits against Apple in Germany, accusing the iPhone maker of violating a patent related to 3G/UMTS wireless communications. The lawsuit included 7 different patents; six of these patents are tied up in four other lawsuits. Though Voss did not provide a reasoning for his pronouncement, if he had determined that Samsung's 3G patent was invalid, the outcome of the lawsuit would have been a stay rather than a rejection.

"There are two reasonably likely possibilities: either Apple's products weren't deemed to infringe on the patent in a technical sense or the court believes Samsung's rights are exhausted and Apple has, by extension, a technical license," Mueller wrote.

A Closer Look at iBooks Author

ibooksauthor

Yesterday Apple released an easy to use tool called iBooks Author, which allows anyone (publishers and users) to create interactive iBooks with text, video, images and more. iBook Author can export projects in a number of different formats, including iBook format, PDF and text.

The iBooks (version 2) format is an improved format created by Apple based on ePub 3. At present, this iBook format will only work with Apple's iOS devices. Even so, Apple has restricted sales of any iBook formatted documents coming from iBooks Author to the App Store.

The reason probably is that Apple may simply not want to feed content to competing bookstores such as Amazon or Google.

"Customer response to our products in China has been off the charts," Apple Chief Executive Tim Cook said in a statement. "With the launch in China next week, iPhone 4S will be available in over 90 countries making this our fastest iPhone roll-out ever."

In addition to China, Jan. 13 will also mark the launch of the iPhone 4S in Anguilla, Antigua and Barbuda, Bolivia, Botswana, British Virgin Islands, Cameroon, Cayman Islands, Central African Republic, Dominica, Dominican Republic, Ecuador, Grenada, Guam, Guinea Conakry, Ivory Coast, Jamaica, Kenya, Madagascar, Mali, Mauritius, Niger, Senegal, St. Vincent and The Grenadines, Trinidad and Tobago, Turks and Caicos and Uganda.

Apple Fails to Win U.S. Injunction Against Samsung

apple_samsung_logos

Late last week, a U.S. judge Lucy Koh declined to award a preliminary injunction over Galaxy line of smartphones and tablets in the United States. The Judge admitted that Samsung infringed some of Apple's patents, but she declined to issue a ban, because of a lack of evidences.

In her ruling, Koh wrote that for some of the smartphones, "Apple has established a likelihood of success on the merits at trial."

Koh added that Apple would likely prove Samsung infringed one of its tablet patents. However, Apple had not shown that it was likely to overcome Samsung's challenges to the patent's validity, Koh wrote.

Apple must demonstrate both infringement and validity to succeed in its lawsuit.

Interestingly, Apple has licensed to third parties one key iOS patent covering the "scrollback" feature displaying the linen texture when elastically scrolling beyond the end of a document or webpage. Licenses for the patent were obtained by Nokia and IBM, and Apple offered a license to Samsung.

Apple asserted this patent against Samsung as part of its failed attempt to get an injunction against Galaxy devices, and the court order denying the injunction includes general discussion of how past licensing behavior affects the decision of whether or not to grant an injunction. The discussion is nestled among two redacted statements shown to The Verge that confirm the '381 patent was licensed to IBM and Nokia, and that Apple offered a license to Samsung in November of 2010 as part of settlement negotiations.

The fact that Apple has been willing to gain profit from a license offered to other companies undermines its argument that it is being irreparably harmed by Samsung's alleged infringement.

Steve Jobs' wife to manage $4.6 billion trust of Disney shares

disney

After Steve Jobs’ death, speculations arose on what would be done with his huge estate, estimated in $7 billion. The majority of his wealth is represented by the 138 million shares of the Walt Disney Co. that were placed in trust. Jobs acquired shares in 2006 having sold Pixar to the company for $7.4 billion. Tax experts suggest that Job’s family should sell all Apple and Disney share to avoid higher taxes. According to Bloomberg, the family could save $867 million in capital gains taxes.

Noteworthy, placing shares in a trust is also a method to avoid higher taxed, though it’s not clear what type of trust was set up in this case. According to Bloomberg, Jobs moved his assets into trusts toward the end of his life.

Now the widow of Apple co-founder Steve Jobs, Laurene Powell, will manage a $4.6 billion trust. Some experts expect her to use a portion of the trust for charity and philanthropic work, as she is an active participant in the non-profit sector.
